By accessing or using Prompteus ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Prompteus is an AI prompt marketplace that allows users to buy and sell prompts for various AI models. We provide the platform and tools but do not create or endorse specific prompts.

3. User Accounts

Account Creation

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You must be at least 18 years old to use the Service
  • One person or legal entity may not maintain more than one account

Account Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your login credentials
  • Notifying us immediately of any unauthorized use

4. Buying and Selling Prompts

For Sellers

  • You retain ownership of your prompts
  • You grant buyers a license to use purchased prompts
  • You must have the right to sell the prompts you list
  • You agree to our 15% commission on sales
  • You must provide accurate descriptions and not mislead buyers

For Buyers

  • Purchased prompts are for your use only
  • You may not resell or redistribute purchased prompts
  • All sales are final unless the prompt is significantly not as described
  • You must have a valid payment method

5. Prohibited Uses

You may not use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or compromise security
  • Harass, abuse, or harm other users
  • Create prompts for illegal or harmful purposes
  • Manipulate ratings or reviews
  • Scrape or automatically collect data
  • Impersonate others or provide false information

6. Content Guidelines

Prompts and content must not:

  • Promote violence, hatred, or discrimination
  • Contain adult or explicit content
  • Facilitate illegal activities
  • Violate third-party rights
  • Contain malware or harmful code

7. Intellectual Property

Your Content

You retain all rights to the prompts and content you create. By listing prompts for sale, you grant us a non-exclusive license to display, promote, and facilitate the sale of your prompts.

Our Platform

The Prompteus platform, including its design, features, and content, is protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of our Service.

8. Payment Terms

  • All payments are processed through Stripe
  • Sellers receive 85% of the sale price
  • Payouts are processed weekly
  • You are responsible for taxes on your earnings
  • We reserve the right to withhold payouts for suspicious activity

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • The accuracy or quality of any prompts
  • That the Service will be uninterrupted or error-free
  • The results obtained from using purchased prompts
  • That the Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTEUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Indemnification

You agree to indemnify and hold harmless Prompteus from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Creating multiple accounts
  • At our sole discretion for any reason

13. Governing Law
